Terms of Use and End User License Agreement

Welcome to Kids Surah ("the App", "we", "our", or "us").

These Terms of Use and End User License Agreement ("Agreement") govern your use of Kids Surah, including the App, its content, features, in-app purchases, subscriptions, and optional donations.

By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree to these terms, you should not use the App.

1. About the App

Kids Surah is an Islamic educational application designed for children and families. The App provides access to the Names of Allah, Surahs, pronunciations, translations, illustrations, and related educational content.

The App does not require users to create an account or log in to access its basic features.

2. End User License Agreement

The App is licensed, not sold, to you. Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the App for personal, non-commercial purposes on devices that you own or control and as permitted by the applicable app-store usage rules.

This license does not transfer ownership of the App or any intellectual property rights to you.

All rights not expressly granted to you under this Agreement are reserved by us and our licensors.

3. License Restrictions

Except where expressly permitted by applicable law, you may not:

• Copy, reproduce, distribute, sell, rent, lease, or sublicense the App.
• Modify, adapt, translate, or create derivative works based on the App.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Remove or alter copyright, trademark, or other proprietary notices.
• Circumvent or attempt to circumvent purchase, subscription, licensing, or security mechanisms.
• Use the App for unlawful or unauthorized purposes.

These restrictions apply only to the extent permitted by applicable law. Nothing in this Agreement is intended to restrict rights that cannot legally be restricted.

4. Ownership and Intellectual Property

The App, including its software, design, graphics, user interface, logos, illustrations, audio, text, animations, and other original materials, is owned by or licensed to us and is protected by applicable intellectual property laws.

The Names of Allah, Surahs, translations, pronunciations, and other content may be based on religious and educational sources and may be subject to their respective copyrights or licenses where applicable.

Your use of the App does not grant you ownership of any content, software, trademark, copyright, or other intellectual property associated with the App.

5. Free and Premium Features

The Names of Allah section is available to all users at no cost. A selection of Surahs is unlocked and available for free; the remaining Surahs are locked and may be unlocked individually through a one-time purchase or accessed in full through a Premium subscription.

We may add, modify, or remove features from the App from time to time, subject to applicable law and app-store requirements.

6. One-Time Surah Purchase

The App may offer an optional one-time purchase of $0.99 to unlock an individual locked Surah.

This purchase is a one-time, non-recurring purchase and does not automatically renew.

The actual price shown to you may vary depending on your country, currency, applicable taxes, and the pricing provided by the applicable app-store provider.

7. Premium Subscription

The App offers an optional Premium subscription that may provide access to all available Surahs and remove advertisements, as described in the applicable subscription offer.

There is currently no free trial associated with the Premium subscription.

The applicable price, billing period, and subscription benefits will be displayed before you complete the purchase.

8. Automatic Renewal

The Premium subscription is an automatically renewing monthly subscription.

Unless cancelled before the end of the current subscription period, the subscription will automatically renew for another monthly period and the applicable subscription fee will be charged through the app-store account used to make the purchase.

Subscription pricing may change in accordance with applicable app-store rules and applicable law. Any applicable renewal price will be presented or communicated through the relevant platform.

9. Cancelling Your Subscription

You can manage or cancel your Premium subscription through the app-store account used to purchase the subscription.

Apple App Store

Subscriptions purchased through Apple can be managed through your Apple account subscription settings.

Google Play

Subscriptions purchased through Google Play can be managed through your Google Play subscription settings.

Deleting or uninstalling the App does not automatically cancel your subscription.

After cancellation, Premium access may remain available until the end of the applicable paid subscription period, subject to the rules of the applicable app-store provider.

10. Payments and App Store Processing

Purchases and subscriptions are processed through the applicable app-store provider, including Apple App Store or Google Play.

We do not directly process or store your complete credit card, debit card, or other payment-card information through the App.

The applicable app-store provider is responsible for payment processing, billing, and related transaction services according to its own terms and policies.

11. Restore Purchases

The App may provide a "Restore Purchase" feature that allows users to restore eligible purchases or subscriptions previously obtained through the same app-store account.

Restoring a purchase does not create a new purchase when the applicable app-store provider confirms an existing entitlement.

12. Refunds

Purchases made through an app store are subject to the refund policies and procedures of the applicable app-store provider and applicable law.

Depending on the platform and circumstances, refund requests may need to be submitted directly through Apple or Google.

Nothing in this Agreement limits any mandatory consumer refund rights provided by applicable law.

13. Optional Donations

The App may offer users the option to make a voluntary donation to support the continued development and maintenance of the App.

Donations are optional, are not required to access any free features of the App, and do not by themselves unlock any locked Surah or Premium feature unless expressly stated at the time of the donation.

Donations are processed through the applicable app-store provider and are generally non-refundable, except as required by applicable law or the refund policies of the applicable app-store provider.

14. Ratings and Reviews

The App may prompt users to rate or review the App on the applicable app store. Providing a rating or review is entirely voluntary and is not required to use any feature of the App.

Any rating or review you submit may be publicly visible on the applicable app store and is subject to that app store's own terms and content policies.

15. Advertising

The free version of the App may display advertisements provided by third-party advertising services, including Unity Ads.

Premium subscribers are intended to receive an ad-free experience as described in the applicable Premium subscription offer.

Advertising availability and functionality may vary based on location, device settings, privacy choices, applicable law, and third-party advertising service requirements.

16. Third-Party Services and Terms

The App may use or provide access to third-party services, including app-store services and advertising services.

Your use of third-party services may be subject to the applicable third party's terms, conditions, privacy policies, and usage rules.

You agree to comply with applicable third-party terms when using the App and any related third-party services.

17. Maintenance and Support

We are responsible for providing maintenance and support for the App to the extent required by this Agreement or applicable law.

If you experience a technical problem, have a question, or wish to submit a complaint concerning the App, please contact us using the contact information provided in Section 27 of this Agreement.

Apple has no obligation to provide maintenance or support services for the App.

18. Islamic Educational Content

The Names of Allah, Surahs, translations, pronunciations, illustrations, and other Islamic educational materials in the App are provided for general educational and informational purposes.

We make reasonable efforts to provide appropriate and useful educational content. However, we do not guarantee that every translation, pronunciation, interpretation, or presentation will correspond to every Islamic school of thought, tradition, or individual preference.

Users and parents or guardians may wish to consult qualified Islamic scholars or trusted educational resources for religious guidance.

19. Children's Use

Kids Surah is designed for children and families.

Parents and guardians are responsible for supervising children's use of the App and for purchases or donations made through their device or app-store account.

Parents and guardians should review the App's content, advertising, purchase options, and device settings before allowing children to use the App.

20. Termination

This license remains effective until terminated by you or us.

Your license may terminate automatically if you materially breach this Agreement.

Upon termination, you must stop using the App and delete it from devices under your control if required by the circumstances of the termination.

Termination does not affect rights or obligations that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, and applicable payment obligations.

21. Warranty

To the maximum extent permitted by applicable law, the App and any services provided through the App are provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by applicable law, we disclaim warranties and conditions, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, satisfactory quality, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, secure, or that defects will always be corrected.

Nothing in this section excludes or limits warranties or rights that cannot legally be excluded or limited under applicable law.

22. Product Claims

You acknowledge that we, and not Apple, are responsible for addressing any claims by you or a third party relating to the App, including claims concerning product liability, legal or regulatory compliance, consumer protection, privacy, or your possession or use of the App.

Nothing in this Agreement limits our liability beyond what is permitted by applicable law.

23. Intellectual Property Claims

In the event of a third-party claim that the App or your permitted possession and use of the App infringes a third party's intellectual property rights, we, and not Apple, are responsible for addressing the claim, including investigation, defense, settlement, and discharge, to the extent required by applicable law.

24. Legal Compliance

You represent and warrant that you are not located in a country or region subject to applicable United States government embargoes or restrictions and that you are not listed on applicable United States government restricted-party lists.

You agree not to use or export the App in violation of applicable laws, regulations, or export-control requirements.

25. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising from or related to your use of, or inability to use, the App.

Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited under applicable law.

26. App Store Provider Terms and Apple Third-Party Beneficiary

This Agreement is between you and the developer of Kids Surah and is not an agreement between you and Apple.

Apple is not responsible for the App, its content, maintenance, support, warranties, or claims relating to the App, except as otherwise required by applicable law.

You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement and that, upon your acceptance of this Agreement, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.

Your use of the App must also comply with applicable Apple App Store usage rules and other applicable app-store terms.

28. Privacy

Your use of the App is also subject to our Privacy Policy, which describes information that may be processed through the App, including information processed by third-party services such as Unity Ads and app-store providers.

29. Changes to These Terms

We may update these Terms of Use from time to time to reflect changes to the App, services, legal requirements, or applicable app-store requirements.

Updated Terms become effective when published on this page unless another effective date is stated.

Your continued use of the App after updated Terms are published constitutes acceptance of the updated Terms to the extent permitted by applicable law.

30. Governing Law

This Agreement will be governed by the laws applicable to the developer and the user's location, except where applicable law requires otherwise.

Nothing in this Agreement is intended to deprive consumers of mandatory rights or protections available under the laws of their jurisdiction.

31. Entire Agreement

This Agreement, together with the Privacy Policy and any applicable additional terms presented with purchases, subscriptions, or donations, constitutes the agreement governing your use of the App, except where additional terms are expressly provided.
